Months ago, Massachusetts voted to legalize medical marijuana and with medical marijuana comes medical marijuana dispensaries. The problem that has arisen across the state is that many towns do not want to have medical marijuana dispensaries within their borders. Many towns have tried to ban medical marijuana dispensaries through zoning regulations, however, the Massachusetts Attorney General’s office has said this month that towns can’t ban the dispensaries.
While towns can’t completely ban the dispensaries they can adopt zoning regulations that limit where in the town the dispensaries can open so long as the zoning regulations are not “clearly arbitrary and unreasonable, having no substantial relation to the public health
