Massachusetts law offers strong protections for a non-biological parent’s rights, but custody and visitation issues can still arise. For example, when some LGBTQ+ couples separate or divorce, courts have granted custody only to the biological parent. Securing your rights and preparing early is always in your best interest. We recommend that both parties appear on the birth certificate and that the non-biological parent formally adopt the child.

Reproductive Agreements
LGBTQ+ couples starting a family often use reproductive agreements, such as sperm donor agreements. Have an attorney represent you when you enter into one of these agreements.
